Went for my ride today, and the council had resurfaced one half of the road, my side, and there was so much loose stone that some had stuck to my tyre and shattered the front right crud 2 where the tie wrap goes on the brake, as a result the rest of the mudguard tried to go past the brakes and locked the wheel up and skidded outwards and ended up having a slow fall, luckily on left side, as there was a car right behind me and i might not of been writing this if i had gone the other way, i was going really slow as well not going mad or anything, is the council responsible for costs as the guy behind me did stop and got details as he was a bit shocked that he was going to run over me, even when i removed what was left i ended riding on the pavement as i got more stones between the the brakes and tyre, it was almost impossible to ride on.

I have heard that people have successfully claimed for damage to carpets when tar has walked into the house. I don't know whether it's true though, from my experience* with the local council works, I somehow doubt it.
The problem is proving negligence. I think they'd say "we put the signs up saying loose stones, you took the decision to ride on them". Only playing devils advocate here BTW, I think you should be able to ride there, and it's their responsibility to make it safe to do so. The way they do this 'repair' of the roads is nothing short of a disgrace.
*I was driving along one morning ans passed a ride-on mower that was cutting the 1m strip between the road and the pavement. There was a tremendous bang and I was covered in glass. The mower had thrown a stone through my side window. I wrote to the council to get compensation for damages, and they gave me their insurers address. The insurers said something along the lines of "the operative checks the bit he's about to cut for stones and they are not liable", in other words "**** off". My insurers didn't pursue it as it wasn't worth their while because it was muggins here who had to pay the Β£75 excess and they only had to spring for about Β£10.
